So, the things they are looking for is when you go up, someone may have red eyes or bloodshot eyes. Your eyes tend to bounce back and forth; it’s called eye tremors. So they are looking for that, they are looking for anything that may smell like marijuana, they are looking in your car, whether you can tell or not. They are looking around to see if they can see little pieces of it or maybe a pipe. See if you have a frog in your throat, or if it seems like your mouth is tacky, that is also an indicator that you might have been smoking recently.

If the police were to find a joint in your car when they are talking to you at a roadside stop, it doesn’t give them the right to go search your car because now that it is legal here in Colorado that is not a crime. The other part is that if you get a marijuana DUI that doesn’t give them permission to automatically search your car. It used to be that police could use any stop, any arrest, to search your car. Now, they actually have to be searching for evidence of that particular crime. So it doesn’t just, they can’t just jump into your car without more evidence.

The best thing to do if you are driving with marijuana in your car would be to keep it in your trunk in an opaque bag. By opaque, I mean something dark. Generally, when you go to the stores here, they sell it in a black bag—you can’t see through it. Best thing to do if you pick it up and it’s in that black bag, put it in your trunk immediately. Don’t get it out and put it into the driver’s compartment.
