What Can I Expect When Calling About DUI Defense in Denver?

In this video, Denver DUI defense lawyer Jake Johnson explains what a person can expect when calling an attorney after being accused of drunk driving or driving under the influence of marijuana.

Jake walks you through the process of what happens when you first go to court up to the date of a potential trial. Unlike other DUI defense attorneys, the lawyers at Thomas Law Firm are former DA’s and prosecutors themselves who have tried hundreds of cases throughout their careers.

Our process here at Thomas Law Firm is this: somebody calls us up, and they say, “Got a DUI the other night, need some help.” We get them in. We do a free consultation with them. We talk about the facts of their case. We talk about the potential defenses. We talk about the costs. Once we get all signed up, we file an entry of appearance with the court, which tells the court we’re representing them. It tells the police officers and the DA, you can no longer talk to this person. You got to come through us.
Then we get them on the trial docket, which means that we’re going to go to court. We’re going to appear for them. On the first appearance, we’re going to go in. We’re going to talk to the DA about the case, get an understanding of what the DA’s looking at. Are they trying to put somebody in jail? Are they going to give them probation? Get a basic understanding of the case. From there, generally we’re going to put it over for a trial setting.

In the interim, we’re going to talk to our client about the potential things they can do. Do they want to try and go ahead and get some evidence suppressed if there’s a legal basis to do that? Do they want to take a plea? Do they want to do some more investigation? Do they want to go to a jury trial?

These DUI and marijuana cases are much more amenable to a trial because you can fight back. A lot of times the DA, they don’t think people are going to go to trial, because most of them don’t. There’s a lot of lawyers out there that for one reason or another, maybe they’re uncomfortable with trial, maybe they don’t like to. We here at Thomas Law Firm, we’ve all gone to trial. We’ve all been prosecutors and gone to trial hundreds of times. These DUI cases, they do. You can go back. I tell people when they come in with a DUI, marijuana, I say, “These are great cases to go to trial on.” If they’re not going to give us a good deal, push them to trial, and we’ll go the distance.
